Correct, the "literal interpretation" of the 14th amendment is very strong as set by SCOTUS in Wong Kim Ark (1898) in which they state that children of PERMANENT RESIDENTS are covered under the 14th amendment.

Incorrect, SCOTUS rulings on constitutional questions are retroactive by default because to attempt to argue otherwise would be to claim that SCOTUS has the AUTHORITY or POWER to alter the US Constitution which they do not.

The POWER to alter or AMEND the US Constitution solely wrests in Article V.

SCOTUS interpretations of constitutional questions are retroactive in nature because their rulings are seen as enforcing Constitutional Law - The highest most supreme law of the land - as it ALWAYS WAS.

Forum shopping is a massive problem in the current federal judiciary. Roberts wants to set a proper framework for this for all time. Also clarifying what happens if a particular federal appeals court upholds or strikes one down libtards can't just go to another federal district and keep playing stump the Trump until they win federal lawsuit purgatory aka stall the issue out until his term is over. So what is going to happen is oral arguments. Then they give an opinion which is basically cleaning up congressional laziness in answering a big loophole, then whatever framework they set up the EO goes back to be litigated under that framework. Most likely they will take the most narrow and nothing happening approach and say challenging the presidential executive orders of critical importance has to happen in the D.C. federal circuit. So the cases all move to D.C., citizenship EO blocked and Trump DOJ will spend time fighting it.

Reminder that this ALREADY a constitutional crisis because Congress when it passed the Immigration Nationality Act (1952) that piece of legislation stripped Article 3 courts of their authority over Immigration Cases. The injunctions are ALREADY in violation of the INA which means they are in violation of statute passed by Congress thus it is in direct violation of the US Constitution.

Not only are these judges at war with the executive branch they are also at war with existing statute passed by congress AND the US Constitution.

If you were born in the United States and your mother had a Green Card and your father was a US Citizen at the time of your birth then you are a US Citizen by birthright according to the 14th Amendment and the majority SCOTUS opinion in Wong Kim Ark (1898)

If your father was born from an illegal migrant then your fathers citizenship status will be revoked, same for his parents parents, etc. going all the way back to 1929 when the Green Card System was created.

Before 1929 if you entered the country legally by going through its ports, train stations, or one of the many checkpoints along the border then you were considered to have "Permanent Residency" status simply by going through a checkpoint as before 1929 the immigration process was much different and individuals would actually get medical checkups at the border, it was a very different system than after 1929.
