Honestly I think she just got lazy with it at some point. Cause if she sets up Harry Potter as the boy who lived through a crucio, then throughout the entire series she would've had to either retcon the reason why Harry is special, which would have taken effort, or she would have to enforce the idea that crucio be really really complicated to cast, but she wanted quick wand battles of people crucio'ing each other up the ass. She clearly must have wanted it both ways (giggity) locking in what would otherwise be a completely broken magic system.
