There is now no presumption of do what the fuck you are told in an orderly manner and if it's wrong you can sort it out later in court.

Now people who want to fight with cops about what they think the law is can intimidate cops who may only be 80% sure they would be found in the right by threatening violence. If you are only 20% sure you are right you can threaten violence at a cop to even the odds. Odds are they back down, because fuck they get paid either way.

The way it always has to work is: You have your rights. The cop can violate them, and you just let it happen, then you seek redress in court later if you feel your rights have been violated. A habeas writ would be your legal recourse if the cops decided to hold you indefinitely without charge, which they might want to do for example to cover up crimes they committed against you during an improper arrest.

Yes it's your right if detained to be brought before a court and get a hearing within a reasonable time ( usually three days ). That should be enough time to be deported. In that case habeas corpus is served since you were released before the time limit ( in mexico ).

Well say you're arrested ostensibly because you're suspected of being here illegally. You say that you have proof of citizenship, but the cops don't believe you, or at least say that they don't. You say that you demand to see a judge so that you can prove that you're being held illegally, and they say that as a noncitizen you have no such right.

Why would you be deported? The cops aren't totally stupid. They're just holding you indefinitely not because you're illegal but for some other reason, like to cover up their own unlawful abuse.
Or maybe you are deported, maybe not to Mexico but somewhere further south, and with some luck you don't wind up in prison, but still you'll make the walk. With no ID how do you expect to be let in?
