Say I’m out in public filming with my phone. I start recording generally in a public place – no hidden camera, just obvious phone filming. A woman walks up some stairs in front of me, wearing a short skirt and (for whatever reason) no knickers. The camera unintentionally catches a full shot of her bare backside. She’s in public, she’s chosen to dress that way.
Is this illegal to record and keep? Is it considered voyeurism even though it’s public and not covert?

It's typically illegal because there is a reasonable expectation of privacy regarding your underwear and genitals even in public. Even if they're not wearing underwear they are still wearing clothes that would otherwise not expose them to the public eye under normal circumstances. I can't imagine you'd get into a ton of legal trouble but you'd probably get banned from wherever you were attempting this eventually. You'd have to try over and over and it would become obvious what you're trying to do.

There aren't any laws against public photography explicitly in this country, the only exception is some very specific legislation involving safeguarding children, I think, but besides that you can record anything you like in public, even if retards tell you not to.

I can't remember the details of that one, but I remember what you're on about. If he was only filming them in public and it didn't constitute harassment (as in, targeting a specific person on 2 separate occasions or more) then no charges can be brought against that person because there aren't any specific laws that prohibit public photography in the UK.

Not necessarily. It could come under the Malicious Communications Act if the video is intended to be threatening or abusive in some way, I think.

Regardless of what the actual law is, I think you would be putting yourself in a position to have to deal with a lot of bullshit. I could see you being arrested and a prosecutor trying this case for ideological reasons, even if you could eventually prove your case.
