Patents protect functional ideas, and once they expire, they're expired forever no matter what. If you invent a machine with a new function, you can patent "a machine with this function" and you can copyright your specific design, but once the patent expires, anyone can make a machine that does that function (but maybe not with your exact design if your copyright is good).

If you make a strong effort to protect your design, then you can sue the pants off of, say, an employee who sells it to your competitors or someone who hacks your system and steals it. Utility/Design patents are retarded too and needs to be done away with. Example: no one ever patented the formula for Coca-Cola, and instead of having a limited ~20 year legal monopoly on the production of Coke in exchange for publicly publishing the formula, they have had a 130+ de facto monopoly on the production of Coca-Cola by keeping the formula secret so that their competitors can only try to reverse engineer something that tastes close to the real thing.
