The treaty from 1990, just like the one from 1970, just recognized the de facto existence of a border.
There is a difference between going to the police and telling that your bike has been stolen and you legally handing over the bike to someone else. Some Germans who were expelled from easern Germany filed a lawsuit against the government because they were under the impression that their house and property was just ceded by the government. The supreme court dismissed it because, in their words "The treaty only recognizes the de facto existence of the border" and "does not contain a transfer of sovereignty over east germany to another state". It is astonishing that no one knows about this stuff. Also, the German parliament would not have been able to sign a treaty which cedes anything without a referendum. If the Bundestag just had a casual vote on handing over bavaria to china, this would be as illegal as handing over east germany to other states as well. So, in order to avoid all of this, the de facto existence of the border was, again, after 1970, recognized. Which is a worthless statement and specifically not a ceding of territory.

3. The Potsdam agreement clearly states, and it was repeated in the 1990 negotiations: The border issue will be dealt with at the peace conference and not earlier. See Art. 79

4. An annexation can not be "healed" by later trying to legally approve of it. So even if the conditions I mentioned earlier would be met, it would still not change the fact that it was an annexation and therefore can never be legalized. It violates the Stimson-Doctrine, among other things.

But it is best if most normies remain normies, as this makes sure that the topic remains dormant for now. It is better this way, at least for now.
